I. WHAT IS COVERED
During the term of this Limited Warranty, We will pay the Cost to repair a Failure of up to 1,000 square feet of Covered Polyaspartic Foor
Topcoat System applied to the Residence garage flooring, due to delamination, peeling, or flaking, caused by manufacturer defect, subject to the
terms, conditions, and exclusions under this Limited Warranty. Such service will be performed with reasonable promptness and quality. See also
EXCLUSIONS - WHAT IS NOT COVERED. REPAIRS REQUIRED DUE TO IMPROPER INSTALLATION ARE NOT COVERD UNDER THIS
LIMITED WARRANTY.
DEFINITIONS
Cost, Repair Cost – mean the usual and fair charges for materials and labor necessary to repair the covered garage flooring. Replacement of any
Polyaspartic Floor Topcoat System may be made with products of comparable chemical composition and quality standards if the original
product is no longer available. Note: Minor differences in color may occur due to the repair process; color differences are not covered by
this Limited Warranty.
Failure - means the delamination, peeling, or flaking of the Polyaspartic Floor Topcoat System, applied to the garage floor of a Residence,
caused by manufacturer defect, excluding normal wear and tear and items excluded under the EXCLUSIONS - WHAT IS NOT COVERED section of
this Limited Warranty. Cracks caused by defects in the concrete floor substrate are not considered a Failure and are not covered by this Limited
Warranty. Failure does not include any damage caused by improper installation.
Limited Warranty - means this 10-Year Polyaspartic Floor Topcoat System garage flooring Limited Warranty.
Polyaspartic Floor Topcoat System – means a two-part chemical flooring application process. The process consists of an initial application of
“Direct to Concrete” colored epoxy primer, that wicks deep into the concrete surface and contains a minimum eight-pound Moisture Vapor Emission
(MVE), followed by the application of optional colored flakes or chips, and the Polyaspartic Floor Topcoat.
Residence – means the property at which the garage floor has been properly prepared and treated with the Polyaspartic Floor Topcoat System. A
Residence does not include a building floor used for commercial purposes or floor systems subjected to mechanical repair operations, or any other
flooring besides garage flooring.
Dealer/Installer – means the person or company that installs the Polyaspartic Floor Topcoat System at the Residence.
We, Us, Our, Administrator, Warrantor – mean American Guardian Warranty Services, Inc., P.O. Box 768, Warrenville, IL 60555; (888) 393-4629,
www.agws.com.
You, Your, Customer – mean the person who signs and is listed on the first page of this Limited Warranty, or a transferee if transferred according
to the provisions of this Limited Warranty.
II. WHAT TO DO IF THERE IS A FAILURE
ALL REPAIRS MUST BE AUTHORIZED BY THE ADMINISTRATOR PRIOR TO BEGINNING ANY REPAIRS COVERED BY THIS LIMITED
WARRANTY. You must protect Your Residence flooring from further damage. Failure to protect the damaged area from further damage
may result in denial of coverage. Upon discovery of a Failure, contact Us immediately at (888) 393-4629, but in no event more than 30 days
after discovery or coverage under this Limited Warranty may be denied. Furnish the Administrator with such information as may reasonably
be required. We will authorize evaluation of the Failure of the garage flooring at Your Residence and refer You to Your Dealer/Seller. You must
contact Your Dealer/Seller and they will inspect the Failure for coverage and perform any necessary repairs. If requested, You must permit the
Administrator to examine Your Residence.
III. TERMS AND CONDITIONS
YOUR RESPONSIBILITIES FOR MAINTENANCE
You must complete all manufacturer recommended Polyaspartic Floor Topcoat System maintenance. Clean only with mild detergents and
DO NOT utilize any caustic cleaners containing abrasive chemicals or acids. Please refer to manufacturer’s care and maintenance instructions.
Upon discovery of a Failure, you must protect Your Residence floor from any further damage.
EXCLUSIONS – WHAT IS NOT COVERED
Where permitted, the following are excluded from coverage:
•
Repairs beyond those required to correct a Failure.
•
Any defects in the concrete floor substrate or cracks caused by defects in the concrete floor substrate.
•
Any defects or damage caused by improper installation. Contact the installer if You have concerns regarding installation.
•
Minor differences in color due to the repair process.
•
Floors that are not garage floors, or any failures to garage flooring over 1,000 square feet.
•
Floors or Residences used for commercial purposes or floor systems subjected to mechanical repair operations.
•
Any covered repair not authorized in advance by Us.
